Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the Cosmium Journey website (this “Site”) and the Cosmium Journey experience on Roblox (the “Experience”), operated by Cosmium Studios (“we”, “us”, “our”). By visiting the Site, joining our community channels, or playing the Experience, you agree to these Terms. If you do not agree, do not use the Site or the Experience.

These Terms apply in addition to Roblox’s Terms of Use, Privacy Policy, and Community Standards. Where Roblox’s rules conflict with ours regarding activity on their platform, Roblox’s rules control for that activity.

2. Eligibility

You must have a valid Roblox account and meet Roblox’s age and regional requirements to play the Experience. If you are under the age required to consent in your country, you may use the Site and Experience only with permission from a parent or legal guardian who accepts these Terms on your behalf.

3. Fan project disclaimer

Cosmium Journey is an unofficial fan experience inspired by creature-collecting adventure games. It is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Game Freak, Creatures Inc., or any of their subsidiaries or partners. References to similar gameplay, creatures, or themes are for descriptive purposes only.

The Experience is built on Roblox. Roblox is a trademark of Roblox Corporation. We are independent creators using the Roblox platform under its applicable developer terms.

4. The website and the game

The Site provides information, links to community channels, and legal pages. The Experience is hosted on Roblox and may be updated, reuploaded, or temporarily unavailable due to platform actions, maintenance, or technical issues. We do not guarantee that every link on the Site will always point to the latest published version of the Experience.

5. Acceptable use

You agree not to:

• Exploit bugs, cheats, automation, or third-party tools to gain unfair advantages
• Harass, threaten, impersonate staff, or discriminate against other players
• Attempt to steal accounts, scrape private data, or attack our Site or Experience
• Sell or trade in-game items or accounts for real money outside allowed Roblox systems
• Use the Experience or community spaces to promote unrelated scams, malware, or illegal content
• Reverse engineer or copy substantial parts of the Experience without permission

We may investigate reports of misconduct and take action including warnings, temporary restrictions, permanent bans from community channels, or reports to Roblox moderation.

6. Virtual items and purchases

Any Robux purchases, developer products, or premium features offered inside the Experience are subject to Roblox’s payment terms and refund policies. We do not process payments on this Site. All sales are final except where Roblox or applicable law requires otherwise.

Virtual progress, items, and currency have no real-world cash value and may be modified, balanced, or removed as part of game updates.

7. Player data and progress

We work to keep player progress backed up, as described on our FAQ. However, data loss can still occur due to platform outages, enforcement actions, bugs, or force majeure events. You are responsible for following account security best practices on Roblox (strong password, two-step verification where available).

We may reset, migrate, or adjust player data when necessary for balance, compliance, or technical recovery, and will try to communicate significant changes through Discord or in-experience notices when possible.

8. Intellectual property

The Site design, branding, original artwork, code, and original game content we create are owned by Cosmium Studios or our licensors. You receive a limited, non-exclusive, revocable license to access the Site and play the Experience for personal, non-commercial entertainment.

You may not copy, redistribute, or commercially exploit our assets without written permission, except where allowed by Roblox platform rules or applicable fair-use law.

9. Community content

If you submit feedback, bug reports, art, or suggestions in Discord or other channels, you grant us a worldwide, royalty-free license to use that material to improve the Experience without obligation to compensate you, unless we agree otherwise in writing.

Do not submit content you do not have rights to share. We may remove content that infringes third-party rights or violates these Terms.

10. Third-party services

Links on the Site may take you to Discord, YouTube, TikTok, X, Roblox, or other services we do not control. Your use of those services is governed by their own terms and policies. We are not responsible for their availability, conduct, or data practices.

11. Disclaimers

THE SITE AND EXPERIENCE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMIUM STUDIOS AND ITS TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SITE OR EXPERIENCE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THESE TERMS OR THE EXPERIENCE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DIRECTLY IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50), IF YOU PAID US NOTHING.

13. Indemnification

You agree to defend and hold harmless Cosmium Studios from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site or Experience, your violation of these Terms, or your violation of any third-party rights.

14. Suspension and termination

We may suspend or terminate your access to community channels or restrict participation in the Experience at any time, with or without notice, for conduct we believe violates these Terms, harms other players, or creates legal or platform risk.

15. Changes to these Terms

We may revise these Terms at any time. The “Last updated” date at the bottom of this page shows when the latest version was posted. Material changes may also be announced on Discord. Continued use of the Site or Experience after changes become effective means you accept the revised Terms.

16. General

If any part of these Terms is found unenforceable, the remaining sections stay in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Cosmium Studios regarding the Site and Experience.
